California Revokes 17,000 Commercial Driver’s Licenses Amid Controversy

California is set to revoke approximately 17,000 commercial driver’s licenses issued to immigrants, a decision that arises from legal concerns over expiration dates overlapping with the permitted stay of the drivers in the United States. This development comes in response to scrutiny from federal authorities, notably the Trump administration, regarding the issuance of licenses to individuals in the country without official authorization.

The situation garnered heightened attention following a tragic incident in Florida, where an unauthorized truck driver executed an illegal U-turn, resulting in a crash that claimed three lives. This incident spurred discussions around the regulatory practices of states like California, which have permitted undocumented immigrants to obtain commercial licenses, thus raising questions about public safety and compliance with federal laws.

Transportation Secretary Sean Duffy has been vocal in his criticism of California’s licensing practices, asserting that the state’s acknowledgment of these mistakes is a necessary step towards accountability. Initially, California defended its licensing policies but later initiated a review after Duffy’s concerns were brought to light.

“After weeks of claiming they did nothing wrong, Gavin Newsom and California have been caught red-handed,” Duffy stated. He emphasized that the revocation signals only the beginning of ongoing efforts to ensure compliance with federal regulations.

Governor Gavin Newsom’s office clarified that all affected drivers had previously possessed valid work authorizations from the federal government. However, the licenses were revoked as they did not comply with state law, which mandates that the licenses must expire before or on the date the individual’s legal status in the country terminates.

In a statement, Brandon Richards, a spokesperson for Newsom, criticized Duffy’s comments, claiming he was spreading misinformation for political gain.

Trucking Incidents and Safety Concerns

The tension surrounding commercial driver’s licenses is intensified by several fatal truck accidents involving drivers without legal authorization. For instance, a recent accident in California that resulted in three deaths has raised further concerns about the safety implications of allowing undocumented individuals to operate large vehicles.

Duffy’s earlier imposition of new restrictions highlights the ongoing national discourse surrounding immigration and public safety. He stated that California was the only state to face immediate actions because it was the first to complete an audit of its licensing practices.

Federal Funding and New Licensing Regulations

As a consequence of these licensing discrepancies, the federal government is withholding $40 million in funding from California, citing inadequate enforcement of English language requirements for truck drivers. Duffy has indicated that another $160 million may also be withheld if the state fails to rectify the identified issues related to improperly issued licenses.

The new regulations announced by Duffy significantly tighten eligibility for commercial driver’s licenses, limiting them to specific visa holders. Only individuals with H-2a, H-2b, or E-2 visas will qualify, which drastically reduces the number of eligible noncitizen drivers. Specifically, it’s estimated that merely 10,000 out of 200,000 noncitizens with commercial licenses will meet the new criteria.

Implications of the New Rules

These regulations are expected to impose strict verification protocols to ensure compliance with federal immigration databases, while also limiting license validity to one year unless a driver’s visa expires sooner. Notably, these new guidelines will not apply retroactively, allowing current drivers to retain their licenses until their next renewal.

Duffy reported that investigators found significant issues during their review, stating that one-quarter of the licenses assessed were improperly issued, with some remaining valid even after the drivers’ work permits had expired for extended periods.
