Santa Anita Park’s Legal Battle Over Racing on Demand Machines

Santa Anita Park has taken a significant step in its ongoing legal battle regarding the use of Racing on Demand machines at its facility. On Monday, the track filed a writ of mandate in Los Angeles Superior Court, seeking intervention from the California Department of Justice (DOJ).

Background of the Legal Challenge

The recent complaint, spanning 52 pages, sheds new light on the state’s confiscation of 26 betting machines that occurred over the weekend. The Los Angeles Turf Club, the petitioner, is contesting the legality of these machines, arguing that they should be permitted for use on concluded races, similar to their use during live races. The state has indicated its intent to destroy the confiscated machines within 30 days unless judicial remedies arise to facilitate their return.

Key Legal Arguments

A primary assertion in the complaint highlights the lack of communication from both the Attorney General’s office and the California Horse Racing Board (CHRB) regarding the legality of the machines prior to their confiscation. According to the lawsuit, the track provided a comprehensive legal analysis to both the state agencies, which went unchallenged.

The track’s legal document states:

“Neither the Attorney General’s office, nor the CHRB, ever disputed [the track’s] written legal analysis or stated that the [track] did not have the legal right to offer the 3X3 wager on concluded races.”

Concerns Over Confiscation Procedures

An essential aspect of Santa Anita Park’s argument revolves around the manner in which the machines were confiscated. The track contends that the state acted without a warrant or prior warning. Instead of utilizing less aggressive measures to inform the track about its alleged infractions, 21 DOJ personnel, along with two Arcadia Police Department officers, arrived at the facility with a U-Haul truck to collect the machines.

The 3X3 Wager Explained

The 3X3 wager involves selecting horses that will finish in the top three positions across three different races. This form of betting is popular among fans and adds a different layer to the overall racing experience.

Next Steps in the Legal Process

The outcome of this legal battle could have significant ramifications for Santa Anita Park and the broader horse racing community in California. The writ of mandate aims to rectify what the track perceives as an overreach by government agencies.

Conclusion: A Critical Juncture for Horse Racing in California

This legal dispute underscores pressing questions about regulatory practices in California horse racing. As the Santa Anita Park continues to seek clarity and fairness, the stakes remain high not just for the facility but for enthusiasts who partake in the vibrant world of horse racing.

For further details on the implications of this legal matter, you can stay updated through reliable sources like the California Attorney General’s Office and the California Horse Racing Board.
