TikTok’s Latest Majority-U.S. Owned Venture Sparks Review by California Governor

Introduction

California Governor Gavin Newsom recently announced a review of TikTok’s content moderation practices following a significant development regarding the short video app’s ownership structure. This move comes after TikTok’s parent company, ByteDance, established a majority U.S.-owned joint venture aimed at addressing data privacy and security concerns.

The Joint Venture Agreement

In a bid to circumvent a potential ban, ByteDance finalized a deal to create the TikTok U.S. Data Security (USDS) Joint Venture LLC. This pivotal arrangement ensures that the majority of the ownership, specifically 80.1%, will be held by American and global investors, while ByteDance retains a 19.9% stake. Major investors in the venture include tech giant Oracle, private equity firm Silver Lake, and investment firm MGX, each securing a 15% stake.

This deal marks a key milestone for TikTok amidst ongoing scrutiny from U.S. authorities over national security and privacy concerns. The agreement was reportedly approved by both the U.S. and Chinese governments, highlighting its significance in the geopolitical landscape.

Newsom’s Concerns over Content Moderation

In light of these developments, Newsom’s office accused TikTok of potentially suppressing content critical of President Donald Trump. According to a statement released via X (formerly Twitter), it was confirmed that there had been reports of suppressed content after TikTok was sold to a group that is aligned with Trump.

As part of the forthcoming review, the California Department of Justice is tasked with investigating whether TikTok’s practices violate state laws.

In response to Newsom’s concerns, a representative from TikTok emphasized that issues regarding content delays and accessibility stemmed from technical problems, specifically a power outage impacting a data center. They insisted that the concerns about content suppression were unfounded and linked to these system failures. Users may experience slower load times or difficulties posting content as the company works on resolving these technical glitches.
