California Proposes Bill to Suspend Eviction Proceedings for Individuals Affected by ICE Raids

A new legislative initiative in California aims to provide temporary relief to individuals facing evictions due to economic hardships caused by Immigration and Customs Enforcement (ICE) actions. Proposed by Senator María Elena Durazo, who represents several neighborhoods in Los Angeles—including Mid-Wilshire, Highland Park, Vernon, and Eagle Rock—this bill, known as SB 1243, seeks to safeguard tenants for up to a year if they can demonstrate financial strain stemming from immigration enforcement activities post-June 2025.

The Context of SB 1243

The proposal comes in response to a significant increase in ICE activities that led to the detention of 14,458 immigrants in the Greater Los Angeles area as reported by the UC Berkeley Deportation Data Project. Senator Durazo articulated the urgent need for such measures, stating, “When a family member is taken in an immigration raid, the fear and uncertainty are overwhelming. No one should have to worry about losing their home during such a traumatic time.”

Understanding the Protections Offered

To qualify for the eviction suspension, tenants must submit a signed declaration of detention-related hardship to their landlord within 15 business days of receiving a three-day notice to pay or quit. Eligible hardships can include legal fees arising from the detention of a family member or reduced income due to business disruptions caused by fear of ICE encounters.

Concerns from Landlord Advocates

While the proposal aims to support affected families, it has sparked concern among landlord advocates. Jeffrey Faller, President of the Apartment Owners Association of California, warns that the bill could face legal challenges over potential due process violations, similar to prior issues arising from self-certification processes during the COVID-19 eviction moratorium. He questions the duration of protections offered, noting, “This protection lasts until 180 days after the hardship ends. Who determines when the hardship ends?”

Economic Implications

Faller also stressed that prolonged hardships could financially jeopardize landlords. He suggested that the state should provide direct rental assistance to those proving economic hardship, rather than placing the onus on landlords.

Oron Maher from Maher Commercial Realty expressed concerns that the bill could inadvertently discourage landlords from renting to immigrant communities. He argued that such actions could lead to higher rents, ultimately affecting a broader demographic—including those the bill aims to protect.

Positive Perspectives on SB 1243

Despite the criticisms, Senator Durazo remains optimistic. She emphasized that the bill is a communal effort to counter the adverse effects of the Trump administration’s immigration policy. Citing a February 9 city report, she noted that 82% of surveyed businesses reported negative impacts due to immigration enforcement, with 44% indicating a revenue decline of more than half.

A Balanced Approach

Durazo reassured that this legislation does not eliminate landlords’ rights or invalidate rent obligations. Instead, it aims to create a constructive dialogue for all parties involved, fostering a temporary pause in eviction proceedings.

The Broader Impact on Undocumented Immigrants

According to findings from the California Immigrant Data Portal, undocumented immigrants bear the highest rent burden at 62%. A recent survey by The Rent Brigade suggests this figure could now be as high as 95% among largely undocumented populations. These conditions raise concerns about increased risk of homelessness and further ICE detentions.

Tina Rosales-Torres, a policy advocate with the Western Center on Law and Poverty, co-sponsored the bill and emphasized that policies generating fear and invisibility for families contradict efforts to resolve the state’s housing crisis and integrate immigrants into communities.

Senate Bill 1243 has the potential to create crucial protections for vulnerable populations impacted by immigration enforcement while also addressing housing stability within California. As discussions continue, the bill reflects a crucial balance between tenant rights and the responsibilities of landlords in increasingly complex economic conditions.
